If it's just an implication, I'll go ahead and make it explicit. Yes, some Empath spells require access to empathic sensitivity to function.

All magic users have a confound, a force or attribute that is not itself magical but impacts how they use magic. Empathy is the Empath confound, just as Devotion is the [[Cleric]] confound. It's one of the major things that separates the single discipline of magic use into so many shapes and sizes.

First, let's make sure we're on the same page with the words we're using, since in DR we screw with some common definitions.

Magic: Manipulating mana streams to produce supernatural effects.<br />
Magical: Related to magic as defined above.

Not everything that produces a supernatural effect is necessarily magical, but much of it is. It really depends on each individual item, and how its creator conceives it. For your specific example, [[polo cloak]]s are magical. Your friendly neighborhood magic user can help confirm this:

You sense very strong, unidentifiable magic coursing through the cloak.</i>

A counter example would be [[soulstone]]s, a supernatural material that has nothing to do with magic.
