Empaths are one of two guilds that required a special early-level progression due to the nature of the guild (Warrior Mages is the other one). Instead of circle locking any of the books, they'll be opened up as soon as you acquire both of the initial Heal spells. So low circle Empaths will be required to go: Heal Wounds --> Heal Scars --> Vitality Healing OR Blood Staunching OR Refresh OR Iron Constitution OR Mental Focus The spellbooks continue as normal ones from there.
