Most of the restrictions play into the idea is that the order of aether elementals that are used as familiar spirits enter into service willingly. They are bound to the summoner's will and into a specific form by the magic of the talisman if they answer the summoning, but they can decide to just leave you hanging if you give them a reason to.

Some of the restrictions play into the idea that conventional familiar spirits are either magically very weak, or very tightly bound into a physical form by the summoning. Warrior Mages who have completed all the AP quests should be able to recognize the wisdom of this process.
